This 60-page transcript, from the case brought by Mask against OpenAI (i.e., the need to maintain OpenAI ' s non-profit identity), was recorded in a dialogue between Mask ' s lawyer and Ilya。
Testimonies indicate that, following Ottman ' s dismissal, the OpenAI Board of Directors had negotiated a potential merger with the competitor Anthropic。
Sutskever, in his testimony, recalled that Anthropic had initially expressed his enthusiasm for the merger, and that the deal had the potential to get the CEO of Anthropic's CEO Dario Amodei to take over the merged OpenAI. Sutskever himself stated that "it really does not want OpenAI to merge with Anthropic", while the then Director Helen Toner and others supported the idea。
Eventually, the merger negotiations failed to move forward because Anthropic had proposed “a number of practical obstacles”. Testimonies also revealed serious mistrust at the top of OpenAI following the success of ChatGPT. Sutskever admitted that he had documented the suspicious acts of Altman and Greg Brockman by sending a memorandum to the independent director, which triggered the decision to remove him。
In a conversation between Ilya Sutskever and Mask, the lawyer cited a 52-page memorandum written by Sutskever at the timeIt accused Ottmann of displaying an habitual pattern of lying, undermining his superiors and provoking them to fight each other。
Sutskever says he didn't send the memo to Ottoman because"I feel, if he realizes these discussions, he'll find a way to make them disappear."I don't know. Under the double pressure of the collapse of the merger and the threat of resignation of more than 700 employees, including Ilya himself, the board surrendered and Otmann was able to return。
These testimonies were brought to light because Mask was trying to use them as legal ammunition to prove that OpenAI had violated its non-profit mission。
