ON MAY 19, ACCORDING TO CNBC AND THE WALL STREET JOURNAL, THE U.S. FEDERAL JURY IN AUCKLAND, CALIFORNIA, HAS FILED A COMPLAINT AGAINST ELON MuskAppeals OpenAI IN ITS DECISION IN THE CEO SAM OTMANN CASE, IT FOUND THAT MASK'S INDICTMENT EXCEEDED THE STATUTE OF LIMITATIONS AND REJECTED ALL OF ITS CLAIMS。

This case originated in the proceedings instituted by Mask in 2024. He accused OpenAI and Ottman of violating their commitment to operate the company as a non-profit, and stated during the trial that OpenAI had “stoked a charity”。
The jury's decision did not rule on the substance of the charge of “violation of charitable trust”, but found that Mask's indictment exceeded the three-year statute of limitations. The court also dismissed the charges against Microsoft。
FOLLOWING THE RULING, MASK WROTE ON PLATFORM X, CHARACTERIZING THE RESULT AS A "TECHNICAL ISSUE ON THE AGENDA" AND INDICATING THAT AN APPEAL WOULD BE LODGED WITH THE NINTH CIRCUIT COURT OF APPEALS。
At a later hearing, the lead counsel for OpenAI, William Savit, stated that it was "not a technical decision, but a substantive decision" and that Mask was using it as a competitive tool. Microsoft also issued a statement welcoming the award。
