Biden Administration Publishes Interim Final Rule on Proliferation of Artificial Intelligence in Last Week Before Leaving Office

In the last week before leaving office, the U.S. Biden administration, by the Department of Commerce's Bureau of Industry and Security, published the Interim Final Rule on Proliferation of Artificial Intelligence as a continuation of the relevant export control rule of October 2022, which is aimed at taking control of AI technology, safeguarding one's own advantages, and preventing misuse by one's adversaries. The rule expands long-arm jurisdiction and tightens export controls on AI chips and other products, triggering reactions from many sides. China's Ministry of Commerce firmly opposed it, pointing out that it undermines normal trade, market order and scientific and technological innovation. U.S. companies and industry organizations, such as NVIDIA, Oracle, and the Semiconductor Industry Association, protested strongly, arguing that the hasty introduction of the rule without adequate consultation not only harms the interests of U.S. companies, but also may weaken the U.S. leadership and global competitiveness in the field of artificial intelligence. In addition, before the introduction of the rule has already made the relevant chip companies share price decline, its effective need for 120 days of public consultation and approval of the Trump administration .
